1. Agreement to Terms

By accessing or using the Kiku website and services (the “Service”), operated by Kiku (“we,” “us,” or “our”), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

2. Description of Service

Kiku is a language learning platform that teaches languages through short, contextual videos. The Service currently includes a waitlist and related website content. Features and availability may change as we develop the product.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's consent.

4. Accounts and Registration

When you create an account or join our waitlist, you agree to provide accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Reproduce, distribute, or create derivative works from our content without permission
  • Use automated systems to access the Service in a manner that exceeds reasonable use

5.1 YouTube Content and Premium Features

Kiku integrates content from YouTube as part of its learning experience. We want to be explicitly clear about the following:

  • By using Kiku's YouTube-related features, you agree to be bound by the YouTube Terms of Service.
  • All videos are hosted on YouTube and belong to their respective creators. Kiku does not claim ownership of any YouTube content displayed through our service.
  • All YouTube content in Kiku is displayed using YouTube's official embedded player iframe, in full compliance with YouTube's Terms of Service and embedded player requirements. We maintain the standard YouTube player functionality and branding as required by YouTube's terms.
  • Kiku does not charge for or sell access to YouTube videos. Our subscription fees are exclusively for Kiku's premium language learning features, which include but are not limited to:
    • One-click word translations and definitions
    • Structured lessons and interactive learning activities
    • Specialized video-based flashcards for vocabulary retention
    • Comprehensive language learning statistics tracking
    • Personal dictionary and known word count tracking
    • Study time and progress monitoring
  • The YouTube content remains freely accessible, and our premium features are designed to enhance the learning experience by providing additional educational tools and analytics around this content.

6. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, videos, and software — are owned by Kiku and protected by copyright, trademark, and other intellectual property laws. You may not use our branding or content without prior written consent.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Language learning results may vary.

8. Limitation of Liability

To the fullest extent permitted by law, Kiku shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date. Continued use of the Service after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
